The terms “Molala”, “molalacompany”, “molalacompany.com”, “MLL”, “I”, “we”, “our” and “us” when used in these Terms of Sale (Terms of Sale) means Molala Limited. The terms “you”, “your”, “yours”, or “Guest” when used in these Terms of Sale means you, as a user of our website. 

Use of the Website

It is important that you read these Terms of Sale carefully before ordering any products or Items from our website. These Terms of Sale, together with our Terms of Use and our Privacy Policy, govern our relationship with you in relation to your purchase of any Items from our website.

By placing an order for an Item through our website you agree to be bound by these Terms of Sale. If you do not agree to these Terms of Sale, you must cease using this website.

Your Status and Eligibility to Purchase

To make purchases through our website, you will be requested to provide certain personal information. You agree to provide your real name, phone number, billing address, e-mail address and any other personal information reasonably required as part of our registration process. Our Privacy Policy explains how we treat personal information provided by you.

When you order an Item, you will be required to provide payment details. You represent and warrant that the payment details you provide are both valid and correct and you confirm that you are the person referred to in the “billing information” provided.

Registration and Accounts

If you choose to register on our website, our registration process requires you to provide certain information about yourself that is true, accurate, current, and complete. Please refer to our Privacy Policy to understand how we treat your personal data.

Shopping Online

We have made every effort to ensure the correctness of all details, photographs and descriptions relating to Items on our website. We do our best to display, as accurately as possible relevant size, length, colours, textures, weight and dimensions of each Item.

However:

  • Please take note of any measurements provided to get a more accurate idea of the scale of each Item. We have made every effort to ensure that all sizes and measurements are as accurate as possible, but please note that they are approximates only.

  • The actual colours you see will depend on your computer monitor and browser and therefore we cannot guarantee that your monitor’s display of any image is a completely accurate representation of the actual Item.

Availability

Whilst Molala makes every effort to only list Items that are usually in stock, all Items ordered are subject to availability of the Item or Items. Please note that there may be a delay between the time you place an order and the time when we accept your order, which may result in a change to the stock position relating to particular Items. We will notify you as soon as possible if an Item you have ordered becomes out of stock.

Order Process

All orders of Items are subject to acceptance by us. When you place an order, your order constitutes an offer to buy an Item from us. After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this email does not mean that your order has been accepted, rather it is an acknowledgment that we have received your order. Acceptance of your order will take place when your order is confirmed by Molala via email. The contract between you and us will only be formed when we send you the email confirmation. Should any goods or services that have been ordered be unavailable, we will immediately notify you thereof, in which event we will reimburse you in respect of any payments made within 30 days from the date of said notification unless we agree otherwise.

We reserve the right not to accept your order if certain events occur, for example, we are unable to obtain authorisation for payment, an Item is out of stock or withdrawn, there is a system malfunction, shipping restrictions apply to a particular Item or you do not meet the eligibility criteria set out in these Terms of Sale.

Pricing

All Item prices are shown on our website in Hong Kong Dollars. Molala makes concerted efforts to ensure that all prices quoted are correct at all times.

Although we make every effort to ensure that the prices stated on our website are correct, sometimes mistakes can occur. If, prior to dispatching an Item to you, we discover a mistake in the price of an Item you have ordered, we will contact you and give you the option of either reconfirming your order at the correct price or canceling your order. If we are unable to contact you or we receive no reply from you, we will cancel your order.

Prices of items may change from time to time so please carefully check the pricing information provided on our website to confirm the current price of any Item. Any price changes will not affect orders in respect of which we have already sent you confirmation that the Item ordered has been dispatched.

Payment Methods

Payment for all Items can be made by PayPal. Your payment card will be debited immediately upon placing an order and confirming payment.

We use PayPal, a secure third party payment gateway provider, for payments. This means that your payment card details are encrypted and we do not store any sensitive payment-related information (such as credit card details) on our website.

We take all reasonable care to keep the details of your purchase and payment secure but we will not be liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from this website. Molala will not disclose any personally identifiable payment-related information to third parties without obtaining your prior consent.

By making an offer to purchase an Item, you expressly authorise us to perform credit checks and, where we feel it’s necessary, to transmit or obtain information about you from third parties from time to time, including confirming your identity and validating your credit card.

Please note that if you pay for an Item using a payment card with a foreign currency denominated account, the account will still be taken in Hong Kong Dollars at the conversion rate applied by your payment card company at the time of processing your order.

Delivery

All balloons items are hand-delivered and all international orders are couriered using SpeedPost Hong Kong, orders will be delivered to you as soon as they are available, and usually take 5-7 working days from the date of order. However, please note that deliveries may take longer than this due to Products having to be imported into Hong Kong, during busy / sales periods, or due to circumstances beyond our control, and Molala cannot be held responsible for inconvenience caused by these unavoidable delays or the failure by suppliers or delivery companies to deliver on time.

Delivery may also be delayed if a typhoon signal no. 8 is raised or a black storm warning is in effect. Deliveries are made on Monday to Friday between 9.00am and 6.00pm. It is possible to arrange express deliveries, subject to a supplementary charge. If you have not received your delivery within the allocated time frames and have not heard from Molala regarding delivery, please contact us at hello@molalacompany.com

Cancelling Your Order Before Dispatch

If, for any reason, you wish to cancel an order before the Item has been dispatched, please contact us on +852 2980 2823 or by email: hello@molalacompany.com. Please note however that requests for cancellations sent via email may not be actioned immediately which may result in the order being dispatched. If the item(s) has been paid for prior to cancellation, you will be credited for the amount in the form of discount gift cards, which can only be redeemed at www.molalacompany.com

Returns and Exchanges Policy

We want you to be completely happy with your purchase. If an Item is damaged upon receipt then you may return the Item to us in exchange for a replacement of the product or a discount gift card to the value of the returned item.

An Item will only be accepted for a return & exchange if the following conditions are met:

  • The Item is returned to us in a saleable condition, in their original state, with all original packaging intact; and

  • The Item is returned to us within 5 working days of your receipt.

Please ensure that any returned Item is securely repackaged. We recommend that you use an insured registered mail service as returns not received by us cannot be exchanged and Molala will not be held responsible for missing items.

All postage costs for exchanges will be your responsibility except where you have returned an Item to us because it is damaged in transit or is faulty.

Please note that Items marked "Sale" (or similar) are unable to be returned to us for an exchange or refund.

Damaged / Faulty Items or Incorrect Supply

We carefully check each Item before sending and we package each Item with care. If your parcel appears damaged or opened upon receipt, ensure that this is noted with the carrier before signing for your parcel.

In the unlikely event that you receive an Item that is damaged in transit or faulty or the wrong item has been supplied, please contact us first on +852 2980 2823 or at hello@molalacompany.com within 5 days of your receipt. A damaged / faulty Item(s) returned to us in its original packaging, unused, within 10 working days of receipt, will be replaced or a discount gift card to the value of the Item will be issued for you to use to select another Item from our website. Please note that no cash returns will be made.

We will reimburse your postage costs of returning an Item to us, if the return was due to the Item being damaged in transit or faulty.

General

Information on this Website may contain technical inaccuracies or typographical errors. We may change these Terms of Sale at any time. We also reserve the right to amend, vary or remove any Items and any page of this website at any time and without notice.
Please read these Terms of Sale regularly. If you do not agree to any change we make, then you must immediately stop using our website. Any changes made to our Terms of Sale after you have placed an order will not affect that order however, unless we are required to make the change by law.

Indemnities

The customer or end-user shall indemnify Molala Limited against all actions, costs, claims, demands, expenses and liabilities whatsoever, if any, which may be incurred in respect of personal injury to or death of any person or in respect of any loss or destruction of or damage to property which shall have occurred in connection with the performance of the products or vouchers purchased on Molala website.

Governing Law and Exclusive Jurisdiction

These Terms of Sale (together with our Terms of Use, Privacy Policy and all of our policies and procedures) will be governed by the laws of Hong Kong Special Administrative Region of the Peoples’ Republic of China and the courts of Hong Kong will have exclusive jurisdiction.

Acceptance

By proceeding to order an item from www.molalacompany.com, you are confirming that they have read these Terms and Conditions and agree to abide by them. Molala reserves the right to decline to manage any order at any time.
